General terms and conditions of business
1. Definitions
Terms and Conditions : these general terms and conditions. Allvital reserves the right to update these terms and conditions from time to time. Allvital: AllVital Products BV, registered in the Trade Register of the Dutch Chamber of Commerce (Kamer van Koophandel) under registration number 14067332, with address Energiestraat 10A, 1411 AT Naarden, the Netherlands, and with VAT number NL 8095.06.105B01.
Consumer : any natural person who concludes a legal transaction for purposes which can predominantly neither be attributed to his commercial nor to his independent professional activity;
Website : www.allvital.com, including the domains redirected to it.
2. Scope and contractual partners
These Terms and Conditions apply to all contracts concluded via the website between you, as an adult consumer (hereinafter "consumer" or "you"), and Allvital. The version of the Terms and Conditions valid at the time of conclusion of the contract shall prevail.
3. Conclusion of contract
Our offers are subject to change without notice and are subject to change within reasonable limits. The goods offered are sold only in normal household quantities and only to persons of legal age.
Your order on www.allvital.com represents an offer to Allvital to conclude a purchase contract. You place an order with us by placing items in your shopping cart, agreeing to the terms and conditions by clicking the "Checkout" button, entering your email address, delivery and payment details, and clicking the "Buy" button at the end of the ordering process.
Allvital will promptly confirm receipt of your order via email. The order confirmation lists the details of the order. It does not constitute a binding acceptance of the order, but merely informs you that we have received your order.
Only upon acceptance of the offer by Allvital does the purchase contract come into effect, and a claim to delivery of the goods arises. Acceptance of the offer occurs when the shipping confirmation is sent to the email address you provided. You can view your past orders in your customer account, if you have registered one. Registering a customer account is not a prerequisite for placing an order.
4. Prices
For orders, the prices listed for the products at the time of the order apply, in euros (EUR) or Swiss francs (CHF). All prices quoted include VAT and are exclusive of shipping costs. Additional costs for any express or special deliveries will be charged separately.
5. Delivery conditions
Allvital delivers exclusively to the following countries: Belgium, Germany, France, Italy, Liechtenstein, Luxembourg, Netherlands, Austria, Switzerland, Slovenia, Czech Republic and Hungary.
Our delivery times are generally 2 to 5 working days for deliveries within the European Union (EU) and 4 to 6 working days for deliveries to Switzerland and Liechtenstein. If delivery is delayed, or if the order cannot be fulfilled or can only be partially fulfilled, you will be notified. In this case, you have the right to withdraw from the contract free of charge. If the goods are not available due to force majeure or product discontinuation, or if Allvital is unable to procure the ordered products under reasonable conditions, and if these circumstances only arise after the contract has been concluded and are not the responsibility of Allvital, Allvital will be released from its delivery obligation. If events occur that make delivery significantly more difficult or impossible for Allvital - for example, strikes, lockouts, official orders, or similar - Allvital is not responsible for delays, even if binding deadlines and dates have been agreed upon.
The delivery address is the address you provided when placing your order. If you are not home, your package will be left either at a DHL Parcelshop (DHL delivery) or at the post office (Swiss Post delivery). You will receive a DHL email or a Swiss Post collection slip as soon as your package is ready for collection. Please allow approximately 7 days for collection; after that, the package will be automatically returned. We will charge the shipping costs for a second delivery attempt.
6. Terms of payment
We offer payment options for orders by credit card (Visa and Mastercard), iDeal, PayPal, Postfinance, and invoice. We reserve the right to exclude payment by invoice for new customers. If you pay by credit card, your credit card account will be charged immediately after the order is completed. Please note that we only accept payments from accounts within Switzerland and the EU. Under no circumstances do we cover the costs of a money transaction.
All information you provide on our website is stored in a secure area. We use the SSL method (Positive SSL Certificate from Comodo), which is considered the most secure worldwide, to encrypt your data. Therefore, both credit card information and bank details entered are highly protected from third-party access.
The invoice will be delivered together with the package. You must pay the amounts due within 10 days of receipt of the invoice. If you default on payment, Allvital reserves the right to additionally charge default interest at the statutory rate, as well as reimbursement of necessary and appropriate reminder and collection costs. You are obligated to report any errors in the payment details to Allvital immediately.
7. Retention of title
Allvital reserves ownership of the delivered products until all amounts invoiced by Allvital, including interest and costs, have been paid in full.
8. Right of withdrawal
You have the right to withdraw from the purchase contract within 14 days without giving any reason. This period begins on the day on which you or a third party other than the carrier designated by you takes possession of the goods. If you have ordered multiple items as part of a single order and the goods are delivered separately, the period begins upon receipt of the last item. For the timeliness of the withdrawal, it is sufficient if the declaration of withdrawal is sent within this period.
To exercise your right of withdrawal, you must notify Allvital of your decision to withdraw from the purchase contract. The withdrawal can be made in any form (e.g., letter, telephone, fax, or email). You may use the withdrawal form enclosed with the package, but this is not mandatory.
You must return the goods to Allvital immediately and in any event no later than 14 days from the date on which you notified Allvital of your cancellation – unopened and in perfect condition. This deadline is met if you send the goods before the expiry of the 14-day period.
In the event of an effective cancellation, we will refund all payments made (excluding return shipping costs) within 14 days of the day on which we received notification of your cancellation of the purchase contract. We may refuse to refund until we have received the goods back. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. Under no circumstances will we charge you any fees for the refund.
We will cover the return shipping costs in the event of a defect. In this case, please contact our customer service.
Please note that we do not grant a right of withdrawal for the following products: Sealed goods that are not suitable for return due to health or hygiene reasons and whose seal has been removed after delivery. Likewise, we cannot accept returns for opened products due to product intolerance.
9. Complaints
Complaints regarding contract performance must be submitted to Allvital within 14 days of the consumer discovering the defects, providing a complete and unambiguous description. Complaints received by Allvital will be responded to within 14 days of receipt. If a complaint requires a foreseeable longer processing time, Allvital will respond within the 14-day period with an acknowledgement of receipt and an indication of when the consumer can expect a more detailed response. If the complaint cannot be resolved by mutual agreement, the dispute will be submitted to arbitration.
10. Dispute resolution
The EU Commission has created an internet platform for online dispute resolution. The platform serves as a contact point for the out-of-court settlement of disputes concerning contractual obligations arising from online sales contracts. Further information is available at the following link: http://ec.europa.eu/consumers/odr. Allvital is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
11. Liability
In the event of a breach of contractual obligations, Allvital is only liable for damages resulting from intentional or negligent conduct. Allvital's liability for damages resulting from improper performance shall in no case exceed the net invoice amount of the products in question.
12. Copyrights
All images, photos, films, and texts published on the website are protected by copyright. Their use is not permitted without the express prior written consent of Allvital.
13. Information on data processing
You consent to Allvital processing the personal data contained in the purchase contract as part of the processing of the purchase contract. You can find more information about how we handle your personal data in our privacy policy.
14. Severability Clause
Should one or more provisions of these Terms and Conditions be invalid or legally ineffective, the remaining provisions shall remain in full force and effect. In this case, the invalid or legally ineffective provisions shall be replaced by legally effective provisions that come as close as legally possible to the economic effect of the invalid provisions.
15. Changes to the Terms and Conditions
Any changes or additions to these Terms and Conditions must be in writing and signed by both parties to be valid.
16. Applicable law
These Terms and Conditions are governed by Dutch law. Any disputes between the consumer and Allvital will be submitted exclusively to the competent court in Amsterdam, the Netherlands.
